Office of Federal Contract Compliance Programs (OFCCP)
The OFFCCP has two broad areas of effort divided between outreach and enforcement. Outreach activities focus on providing assistance to contractors and subcontractors to aid in their understanding and implementation of their legal obligations and how issues of non-compliance are handled. The OFCCP also provides support to help contractors utilize Department of Labor resources to develop job training programs to identify and recruit qualified workers with disabilities.
The OFCCP works closely with a variety of other organizations in the U.S. Federal government to ensure a comprehensive approach to reducing employer discrimination. These include the Department of Justice, the Equal Employment Opportunity Commission, the Office of the Solicitor, the Women’s Bureau, the Bureau of Apprenticeship and Training and the Employment and Training Administration. The goal of that coordination is to ensure the maximum efficacy of resources allocated to addressing issues of discrimination in contractors receiving Federal government contracts.
For most of SSB clients, an area of active interest is the enforcement activities of the OFCCP. The OFCCP has a broad mandate and the authority to both reactively handle complaints from contractor employees and actively police the activities of contractors.
The OFCCP complaint process allows an employee with a disability to file a complaint against the employer with the OFCCP. The OFCCP then funds the investigation and resolution of the issue with the employer and monitors employer conformance with the agreements. This stands in sharp contrast to enforcement activities for other portions of the Rehabilitation Act, such asSection 508, where enforcement activities are unfunded and far less aggressive.
In addition to handling employee complaints, the OFCCP also actively monitors contractors and subcontractors to determine their compliance with the affirmative action requirements of their contracts. These monitoring activities tend to focus on compliance audits against organizations that may have large scale compliance violations.
